(AP Photo\/Ric Feld)<\/figcaption><\/figure>\n<hr \/>\n<p>On Wednesday, in a closely watched case, a state judge in Pennsylvania\u00a0<a href=\"http:\/\/www.washingtonpost.com\/politics\/pa-voter-id-law-gets-approval-of-state-judge\/2012\/08\/15\/8b7fef94-e6ec-11e1-8f62-58260e3940a0_story.html\">declined<\/a>\u00a0to block the state\u2019s controversial voter ID law from taking effect. If the ruling is upheld on<a href=\"http:\/\/pilcop.org\/the-fight-against-the-voter-id-law-continues\/#more-2826\">appeal<\/a>, registered voters in the state will be required to show\u00a0<a href=\"http:\/\/www.seventy.org\/Elections_Voter_ID_Issues_for_All_Voters_Voting_In_Person_at_the_Polls.aspx\">acceptable photo ID<\/a>\u00a0during the general election in November.<\/p>\n<p>There\u2019s been a lot of attention on this lawsuit, given the closeness of the election and greater focus on voter ID laws, which critics say could disenfranchise voters who are likely to lack photo ID, often the poor, elderly, and minorities. (To catch up on this issue, check out our guide on\u00a0<a href=\"http:\/\/www.propublica.org\/article\/everything-youve-ever-wanted-to-know-about-voter-id-laws\">everything you need to know<\/a>\u00a0about voter ID laws.)<\/p>\n<div>\n<p>Yesterday\u2019s\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409351-pennsylvania-august-2012-decision-voter-id.html\">ruling<\/a>\u00a0has generated plenty of<a href=\"http:\/\/www.nytimes.com\/2012\/08\/16\/opinion\/a-missed-chance-to-reject-voting-barriers.html?hp\">criticism<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.theatlantic.com\/national\/archive\/2012\/08\/why-pennsylvanias-voter-id-law-is-unconstitutional\/261218\/\">concern<\/a>. But it\u2019s far from the first time a judge has ruled on voter ID laws, a number of times in favor of them. Indeed, the U.S. Supreme Court has\u00a0<a href=\"http:\/\/www.nytimes.com\/2008\/04\/29\/washington\/29scotus.html\">upheld<\/a>\u00a0Indiana\u2019s strict voter ID law, saying in 2008 that it\u2019s constitutional.<\/p>\n<p>Lawsuits have continued to crop up challenging the laws, mostly on the grounds that they violate state constitutions. Meanwhile, Republican-led state legislatures are continuing to pass the laws.<\/p>\n<p>To get a real sense of where things may be going, it\u2019s helpful to look at the past. Here\u2019s a rundown of state court decisions on voter ID laws:<\/p>\n<p>&nbsp;<\/p>\n<h4><strong>Three rulings in favor of voter ID laws<\/strong><\/h4>\n<ul>\n<li>In July 2007, in an advisory opinion sought by the state House of Representatives, the<a href=\"https:\/\/www.documentcloud.org\/documents\/409025-michigan-supreme-court-july-2007-decision.html\">Michigan Supreme Court<\/a>\u00a0concluded that the state\u2019s photo ID requirement was a \u201creasonable, nondiscriminatory restriction designed to preserve the purity of elections and to prevent abuses of the electoral franchise.\u201d The court said there was no need for the legislature to prove voter fraud existed before taking \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/409025-michigan-supreme-court-july-2007-decision.html#document\/p24\/a67657\">prophylactic action<\/a>.\u201d As part of the ruling, the court\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409025-michigan-supreme-court-july-2007-decision.html#document\/p34\/a67660\">said<\/a>\u00a0the photo ID restrictions were not overly harsh. The opinion included\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409025-michigan-supreme-court-july-2007-decision.html#document\/p86\/a14\">two dissents<\/a>.<\/li>\n<li>In June 2010, the\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409028-indiana-supreme-court-june-2010-decision.html\">Indiana Supreme Court<\/a>\u00a0sided with a lower court judge in dismissing a motion to toss out the state\u2019s voter ID law. The court ruled that the law is a valid \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/409028-indiana-supreme-court-june-2010-decision.html#document\/p10\/a67665\">election regulation<\/a>\u201d and held the burdens were not \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/409028-indiana-supreme-court-june-2010-decision.html#document\/p12\/a67666\">sufficiently unreasonable<\/a>.\u201d In addition, the court frequently referenced the 2008 U.S. Supreme Court\u00a0<a href=\"http:\/\/www.oyez.org\/cases\/2000-2009\/2007\/2007_07_21\/\">decision<\/a>, which upheld Indiana\u2019s voter ID law on federal constitutional grounds. The state Supreme Court\u2019s decision included one\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409028-indiana-supreme-court-june-2010-decision.html#document\/p19\/a68288\">dissent<\/a>.<\/li>\n<li>In March 2011, the\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409029-georgia-supreme-court-march-2011-decision.html\">Georgia Supreme Court<\/a>\u00a0affirmed a lower court\u2019s ruling upholding the state\u2019s voter ID law. It found the state\u2019s photo ID requirement was a \u201cminimal, reasonable, and nondiscriminatory restriction\u201d and repeatedly\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409029-georgia-supreme-court-march-2011-decision.html#document\/p22\/a14\">cited<\/a>\u00a0the U.S. Supreme Court decision as persuasive authority. It also rejected the argument that Georgia\u2019s Constitution afforded greater voting protections than the federal Constitution, arguing it was \u201ccoextensive\u201d and that \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/409029-georgia-supreme-court-march-2011-decision.html#document\/p18\/a67669\">we apply them as one<\/a>.\u201d There was one\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409029-georgia-supreme-court-march-2011-decision.html#document\/p23\/a15\">dissent<\/a>.<\/li>\n<\/ul>\n<div><\/div>\n<h4><strong>Rulings against voter ID laws<\/strong><\/h4>\n<ul>\n<ul>\n<li>In October 2006, the\u00a0<a href=\"https:\/\/s3.amazonaws.com\/s3.documentcloud.org\/documents\/409024\/missouri-supreme-court-oct-2006-decision.pdf\">Missouri Supreme Court<\/a>\u00a0upheld a lower court\u2019s decision striking down the state\u2019s voter ID law for violating the state constitution. The court ruled that there was no compelling state interest to justify\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409024-missouri-supreme-court-oct-2006-decision.html#document\/p7\/a67637\">the burdens<\/a>\u00a0posed by the law. It pointed to the lack of any\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409024-missouri-supreme-court-oct-2006-decision.html#document\/p5\/a67633\">reported instances<\/a>\u00a0of voter impersonation fraud in the state and to the fact that the law was not tailored to prevent other types of voter fraud\u00a0<em>aside<\/em>from impersonation. There was one\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409024-missouri-supreme-court-oct-2006-decision.html#document\/p22\/a68284\">dissenting vote<\/a>.Missouri passed a photo ID law again in 2011, but it was\u00a0<a href=\"http:\/\/www.newstribune.com\/news\/2012\/may\/22\/missouri-voter-photo-id-measure-kept-ballot\/\">vetoed<\/a>\u00a0by Democratic Gov. Jay Nixon. Earlier this year, a\u00a0<a href=\"http:\/\/www.columbiatribune.com\/news\/2012\/may\/23\/missouri-voter-photo-identification-measure-fails\/\">ballot proposal<\/a>\u00a0to amend the state Constitution for a photo ID requirement was rejected by a state judge and not revised before the legislature recessed.<\/li>\n<li>In\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409026-wisconsin-trial-court-march-2012-decision.html\">March 2012<\/a>, the first of two state judges in Wisconsin to rule on the law barred enforcement of the law. The judge\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409026-wisconsin-trial-court-march-2012-decision.html#document\/p9\/a67670\">warned<\/a>\u00a0of possible disenfranchisement of voters that could include \u201cthose struggling souls who, unlike the vast majority of Wisconsin voters, for whatever reason will lack the financial, physical, mental, or emotional resources\u201d to comply with the law.In July, a separate state judge similarly\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409027-wisconsin-trial-court-july-2012-decision.html\">blocked<\/a>\u00a0the law. The judge\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409027-wisconsin-trial-court-july-2012-decision.html#document\/p14\/a67671\">cited<\/a>\u00a0the time and cost of obtaining photo ID and the strong voting\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409027-wisconsin-trial-court-july-2012-decision.html#document\/p15\/a67672\">protections<\/a>\u00a0extended by the Wisconsin Constitution.Although the Wisconsin Attorney General filed an appeal of these two decisions to the state Supreme Court, it\u2019s not likely the appeals will be considered\u00a0<a href=\"http:\/\/host.madison.com\/news\/local\/crime_and_courts\/article_0f7d9fea-d05d-11e1-81ef-001a4bcf887a.html\">before<\/a>\u00a0the November election.<\/li>\n<\/ul>\n<\/ul>\n<p>In\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409351-pennsylvania-august-2012-decision-voter-id.html\">Wednesday\u2019s ruling<\/a>\u00a0out of Pennsylvania, Commonwealth Court Judge Robert Simpson referenced many of these past court rulings, particularly the ones that upheld voter ID laws. He also stressed the need for\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409351-pennsylvania-august-2012-decision-voter-id.html#document\/p37\/a14\">deference<\/a>\u00a0to the Pennsylvania legislature. Criticism of Pennsylvania\u2019s law had intensified after the Republican majority leader of the state\u2019s House had been\u00a0<a href=\"http:\/\/www.politicspa.com\/turzai-voter-id-law-means-romney-can-win-pa\/37153\/\">quoted<\/a>\u00a0saying the voter ID law would benefit Republicans. Although the judge called the remark \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/409351-pennsylvania-august-2012-decision-voter-id.html#document\/p60\/a68024\">disturbing<\/a>,\u201d he wrote that it didn\u2019t change his reasoning.<\/p>\n<p>Pennsylvania\u2019s photo ID requirement, the judge\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/409351-pennsylvania-august-2012-decision-voter-id.html#document\/p61\/a68293\">concluded<\/a>, \u201cis a reasonable, non-discriminatory, non-severe burden when viewed in the broader context of the widespread use of photo ID in daily life.\u201d<\/p>\n<p>That doesn\u2019t end things for Pennsylvania.
